Taking a tough stance agianst anti-social behaviour

A resident living on Ivy Road, Bury has now been evicted for failing to allow access and continued nuisance.
Despite the assistance of Six Town Housing, which included numerous visits, letters, telephone calls and offers of support, Mrs Hamilton failed to allow access and continued to be a nuisance. As a result, Six Town Housing applied for an injunction to gain access to the property and to prohibit Mrs Hamilton from breaching the terms of her tenancy agreement.
The main issues were failing to allow access to inspect the property and carry out essential repairs, making inappropriate and offensive comments towards Bury MBC and/or Six Town Housing contractors and employees, making persistent and excessive telephone and sending persistent and excessive texts to Bury MBC and /or Six Town Housing and causing a disturbance by shouting and using foul language at Bury MBC and /or Six Town Housing Offices.
District Judge Pickup, on September 25, 2009, granted a Injunction Order against Mrs Hamilton for a period of eighteen months and stated that she was not allowed to:-
Engage or threaten to engage in conduct capable of causing a nuisance or annoyance to employees of Bury MBC/STH and/or their contractors, or allow, incite or encourage any other person to engage or threaten to engage in any such conduct.
This included:-
Failing to allow access for inspection and/or carrying out of essential repairs and improvements on 48 hours notice by Bury and/or STH employees or contractors;
Making inappropriate and offensive remarks towards Bury/STH contractors one employees;
Making persistent and excessive telephone calls and sending persistent and excessive texts to Bury/STH;
Causing a disturbance by shouting and using foul language at Bury/STH offices.
Unfortunately, Mrs Hamilton refused to allow access and continued to cause a nuisance. As a result, Six Town Housing instigated possession proceedings and the matter was returned to Court on, December 21, 2009. After careful consideration of the information submitted by Six Town Housing, District Judge Pickup found that Mrs Hamilton had breached the terms of her tenancy agreement. As a result, District Judge Pickup granted possession of the property within 14 days.
Mrs Hamilton refused to vacate the property and a warrant was applied for and executed at 10 Ivy Road, Bury on 20th January 2010.
